  • This does seem to be a violation of the equal protection clause (the bill).

We're talking about equality, something that you hate.

Must be something about checking my priviledge, having something to do with my mustache.

I don't think a law like this would be passed that affected women, so I see a double standard. The other thing is what they really want is for men to be convicted criminally without being proven guilty (just for rape) making men second class citizens.
the proposed law deals with college disciplinary proceedings, not criminal law. i don't see any evidence that criminal law will suffer any changes as a result.

Anyway, as you can see they don't believe body language can give consent.
it's worth thinking about what kind of cases this will be used in. if two people get together and have an enjoyable night of sex (or even a not very enjoyable but still consensual one), then no one is going to complain, even where no one has expressly said 'yes'. so in those cases body language will still count as consent. it seems clear that it's application is going to be in cases where either the woman clearly didn't want sex or where there's ambiguity about exactly what the situation was at the time. as i said, hopefully it will lead to people thinking more carefully about their sexual behaviour.

I agree, but I'll say that that's thanks to those of us who know how important the bill of rights are. There are some that would throw them out the window to prevent even one rape..

I'm more interested in cases where the girl thought the guy really liked her so had sex. After he didn't call she reported a rape. Or something.

And the way to do that is to make the line less clear? I'm not seeing it.

i feel that the likelihood of this scenario happening as described is astronomically unlikely. additionally, an allegation of rape ≠ a trial, conviction, and/or jail sentence in a court of law.

If you don't mind me asking, what kind of relationship do you have with your ex. Mine is bitter as hell and as mean as a badger. Not all women are made of sugar and spice.

You're gonna have to get the crayons out to explain this on reggy's level.

                        • ah, campfire and rape; to be young again.

seriously though, how is making consent clear a bad thing?

I've been accused of attempted murder because I drove away in the car when my wife was stalking me.

                              Sorry, what was the question?

                              • This thread topic reminds me of a heated conversation some years ago online in a chatroom for gay men.

A few of them got around to talking about straight guys and how some of them can be seduced after a lot of drinks, and then one could have his way with him.

I called them out, saying that's not seduction; that is rape.
