Agree. But if their own opinion is the only factor in pursuit of possible criminal charges (First Degree Aggravated Abortion!), they can easily sweep things under the rug, so to speak.

The scientific standard would be that they can determine the date to within a few days by 28 weeks.

If there had been no previous visits, then maybe to within a week. But after repeated visits and as time goes on, they get very exact.

Sure. But if the woman is alleged to be 29 or 30 weeks versus 28, it's enough of a degree of error for a lawyer to get someone off.

Ultimately, it just stops an abortion at the time of birth for a well documented pregnancy. Poor girls in the city who don't go to the doctor will still be able to beat the arbitrary 28 week limit at will.

This is a preemie at 30 weeks.

Is this really the argument you want to be making, Sava?

I don't really think 28 is correct, it should be 'viability' which is closer to 24. However, some scientific discussion is what should be taking place instead of the nonsense 'not taken a breath yet, not a human' and other poor, non-scientific, arguments used by the pro-choice side.

I recognise that ~1 week (maybe even more) uncertainty might exist for a poorly documented pregnant woman at 28 weeks (Even more likely to be the case at 24 weeks) but that is a minor issue.

It wouldn't be 'allowing abortion at will'. It would the sort of uncertainty expected for science.

Sava, the US is the country that will send a woman to jail for months (over a year) for taking her child out of the car seat in a car to breastfeed/comfort.

I assume that if it was the 3rd strike, it would have been 'permanent' and not just for 18 months or whatever it was.

I would personally favor mercy towards women who get abortions (if they were illegal). That would be as important as decriminalising weed/etc (however, drugs will be legal well before late state abortion is stopped).

Agreed. 24 weeks is far superior to 28 weeks.

I don't know what this has to do with anything.

So far, I don't really know what the things you have said have anything to do with what I've said. I only commented on the relative inaccuracy of judging the age of a pregnancy to legal standards.

You seem to have gone off on a bit of a tangent.

You were concerned about people being punished for illegal abortions, and I was saying 'yes, it could happen (look at what the US does now), but it doesn't need to'. Basically, the US police state should be dismantled, but that isn't a reason to make laws neutered.
