You are making the entirely unproven assumption that the death penalty does not deter crime. As it has not been proven in either direction, my stance on the death penalty is that I don't know whether it is right or wrong. It all depends on whether it is effective or not. If you are correct and it is ineffective then of course I believe we should abolish it, but only because it isn't useful.
