Which is why he could have been extradited instead of kidnapped.

How did they smuggle him back to the US anyways?

Would the Mexicans have held Mr. Luster or would they have let him go?

I'm led to understand it's not all that hard to smuggle people into the U.S. from Mexico.

Depending on how corrupt the Mexican police in question would have been, they either would have held him pending a U.S. extradition request or would have taken a massive bribe and let him "escape."

          After a little digging

it appears that the Mexican authorities caught the Chapmans with Mr. Luster, and then deported Mr. Luster back to the US where he was taken into custody by the FBI. Apparently, the FBI had an agent travelling to Puerto Vallarta to ask the Mexican authorities to help locate and arrest Mr. Luster at the time the Chapmans captured him.

Neither country has the death penalty and they refuse to extradite their nationals who might be facing a DP charge without guarantees the DP is taken off the table, something prosecuters don't seem to want to do. So yes, dear, it is the fault of the U.S. All we have to do is say, the DP is off the table and we'll get our suspects.

DEAR??? wtf an american citizens murders 3 people and runs to canada and gets to live hi life in their luxury prisons?? what kind of **** is that? The death penalty whether canada or mexico likes it or not is here in the us. the idea is to support the law enforcement of the country that helps protect you, not house murderers in apartments cause the dont agree with the penalties. Im sorry this idot wasnt kidnapped. He was out on Bail by a us bailbondsman which when he signed his freaking name to that bail slip that he got out of jail he is property of the bondsman that got him out.

So they're bent out of shape that while they were trying to even locate the guy, he was already in custody?
Oh that's smooth. Definitely worthy of prosecution of the bounty hunters.

Foreign private citizens have no authority to act as law enforcement agents in other countries. These guys did something useful, but they were in it for the bucks, and certainly milked it for a lot of publicity. Oh well, they went to another country and disregarded its laws - at least they now have enough money to buy their way out of whatever trouble they might be in.

That only changed very recently. In Mexico (I have no idea about Canada) at least extraditions were banned even in cases where the DP was off the table until the rules within Mexico were changed.

Why not? It's likely what kept Luster out of trouble with the Mexican authorities.

I would think the US would quickly deport a foreign national, illegally in the US for the sole purpose of evading the authorities back home.

Why should we be a haven for every dime store criminal with a sawed off shotgun who can skip across the border?

All you have to do is agree to take the DP out of consideration, and after a little paperwork, the Mounties will deliver your perp over to the US Marshal's service and there you go.

the idea is to support the law enforcement of the country that helps protect you, not house murderers in apartments cause the dont agree with the penalties.
Who protects who from what? The US likes to act as self-appointed lord high protector of the universe (defined as perceived US interests), and expects other countries to bend over when we decide it's time for a little national schlong shwinging, but the rest of the world, except for that poodle Blair, tends to have a bit of a different opinion. Oh, and BTW, the US reserves the right to make its own judgments about other countries legal systems, and can be just as much of a pain in the ass about extradition if it wants to be.

Well, just like the US does with other countries, Mexico doesn't automatically recognize foreign private commercial arrangements (which is what the bondsman has) that are entered into in other countries. There are extradition procedures, but these guys didn't care - they chose to break the law, and good on them for getting the bastard, but they're paid hands and they knew there could be consequences for breaking the law.

Not a death penalty scenario, even in Texas so take that out of the equation.

In most cases, yes, but said foreign national may file for asylum. We took in all sorts of people "illegally in the US for the sole purpose of evading the authorities back home." A lot of former Soviet physicists, for example. It's a case by case situation.

Your government assisting our government is one thing. Do you turn a blind eye to private American citizens enforcing their laws in your country? I don't think the RCMP would be too thrilled to do that.

Hey, it's fine with me if they get shot while resisting arrest. Saves us a lot of time and paperwork.
