I think you'll see you are mistaken. It's also likely a court will apply rationality and strike down the provision from the BNA enforcing taxpayer funded bigotry and priestly sodomy.

An amendment that only affects a province's jurisdiction (religious schools in that province) requires only the provincial legislature, the Federal Parliament, and Royal Assent.

The parts of the Constitution that require the stringent amending formula are the Charter (there is no Charter right to religious schools) the place of the Monarchy and judiciary, the division of federal and provincial powers, and representation guarantees for the provinces federally. (I think that's it.)

I think it is highly unlikely that any court is going to go striking down any significant part of any Constitutional document. It is their function to uphold them.

What a court might do is apply the Charter's protected status for homosexuals to force GSAs in provinces that don't do or already have done as Ontario has done.
