      I used to be in boy scouts. Keep in mind that most troops really don't care if you're gay or not. That said, it is a retarded policy.

          Actually, yes. It doesn't matter whether the Scouts have changed anything. What matters is that Philadelphia is no longer willing or able to subsidize the Scouts as they are. The Scouts want to force the subsidy to keep coming.

          No. That's the best solution for the Scouts, who would then find themselves with a windfall and the ability to play the oppressed victim. And you still haven't shown why the city should pay for the building.

          If the Philly city council wishes to go to court, that will be decided.

          Really, I suspect that litigation will be far more expensive than the value of the building in the end.

          Or Philly could be honourable. Two paths. One has a certain loss, and one has an uncertain loss of far more.
          Fixture law is pretty well-settled. I doubt it would take eight figures to litigate this.

              Because they didn't pay fair market value for the building back in 1928. They didn't pay for the construction costs, or the donated time for upkeep prior to when they sold the building and leased it out. They essentially got the whole building for free. This has to be compensated.

              The Philly council would have been wise to buy the building from the Scouts back in 1928, and they would be better off now. Sadly they did not do so.

              They've also been able to lease the building out to other clients in the meantime, which is a significant income stream that the scouts have not had access to.

              Fixture law is pretty well-settled. I doubt it would take eight figures to litigate this.
              It's a sunk cost. Money they aren't going to get back, even if they win the settlement.

                I think Ben's right, I dont want govt social engineering and thats what they did when they gave the scouts a lease for a $1 and thats what they're doin now with the anti-discrimination law. If it was that simple I'd say the scouts should not get a subsidized lease and the govt should not tell the scouts who they gotta admit. But the scouts built the building! The deal was giving it to Philly in exchange for Philly continuing the lease and paying for upkeep (I guess).

                Course that would sound corrupt if this was some pols' buddies getting that deal, the scouts will probably remain in the building for its relevant lifetime and the taxpayers foot the bill. On second thought, screw that - just shows what a joke we are when it comes to equal protection.

                                Because the government gave them an agreement that they could lease their building back from the government at a dollar a year in perpetuity.

                                That was the arrangement, Asher.

                                This isn't a subsidy to the scouts, and neither is paying the scouts the current market value of the building, because that is the value of the asset which they sold to the goverment.
