    Have you done their type of work before? You know what info was required, where it came from, and how long this takes? If the motion was faulty would it affect the later hearing? I don't know the answers to these questions and I presume you (ZK and the others) don't either. Again, the people closest to the file have provided an explanation. It trumps your shot in the dark.

                • Truns out that it was the Chief justice of the court that shut them out. When they tried to get an extension to file on the phone, rather than going in with a motion, Chief Justice Sharon Keller ordered the clerk to close promptly at 5:PM, even though they commonly do grant addtional time and hold the office open, and indeed in the very case were planning to do so until happened. They managed to to tick her off about something, probably something along the line of being too damn lazy to show up in person to make a motion for extention/continuance (to get more time just to file a worthless appeal for delay purposes) and demanding an extention on the phone. Likely there was something in the tome of the phone conversation as well.

                  As for writing an motion for extension/continuance, I could do it by hand in 5 minutes. So yes, they could have done in if they had just hopped in the car and gone to the courthouse.

                    Including completing work timely, rather than waiting until the last minute. I consider any lawyer who skates deadlines to be defective. The appeal (assuming it had any merit, as opposed to merly being a delaying tactic) should have been filed days earlier. Pushing deadlines whether 5:PM or a few hours later, is a failure strategy.

                          My understanding of the timeline was the appeal was to be based upon an issue the SC had just that day decided to hear... How do you predict this in advance? The psychic team again?
