      You are misunderstanding the law, he was party to crimes that he knew were being commited, he is considered just as guilty of any murder that is commited in the act of commiting another crime.

        Sounds like he's a stupid thug but did not actually kill anyone, nor threaten to kill anyone, or even rob anyone. He was just the chauffeur for the people who did. So the DP is not warranted, IMO. A nice, long jail term would suffice. But this is Texas we're talking about.

          Well, I think I'm done defending this moron. I have beef with this law and with the death penalty, but those are different debates.

          I'm curious as to why the other two people in the car didn't get the death penalty, btw. Does anyone know?

              the guy is guilty of aiding and abetting but to get the death penalty is a bit harsh. This is an abusrd case such as the one that occured in georiga and the blow job. Texas isnt the only ignorant state, they, all 50 of them , have their moments.

                The absurd suggestion you made is that Foster was blissfully unaware that he was the getaway driver in 4 armed robberies especially in light of the fact that I've seen no suggestion that he is mentally retarded.                     If the guy was the getaway driver in robberies, and one robbery resulted in murder, he is usually also guilty under the felony murder law. A murder that results from the commission of a crime can be prosecuted essentially as murder. This isn't new.

                    Of course, when you say Texas is just randomly killing someone who is effectively just driving a friend innocently, you completely distort the debate.

                          According to the testimony of the other people in the car, the driver didn't even know what the murderer was doing.
                          That seems pretty convenient to me. He's there at just the right time for the murder and just happens to drive the murderer where he is going.

                          You ask what would I do if the gunman pointed a gun at me, I'd bail, let him take the car.

                                And you accuse me of lying? Where did I say he was unaware of 4 robberies? Wiglaf and me were discussing hypotheticals before anyone mentioned robbery so dont drag that into this, I dont know if Foster was or was not aware. The guy who suggested they jack people also said Foster didn't know he had a gun or what he was doing when the murder occurred. You quoted the killer but reject his testimony when its exculpatory. Does it matter that the killer said he got into a tussle with the boyfriend of a woman he was hitting on? That aint robbery...
