Foster is stupid and shouldn't have been there at all. He should have known better. It still does not appear, however, that he intended to have any sort of participation whatsoever in a murder.
From what I understand, that means that this Law of Parties thing shouldn't apply to him. I won't argue it too strenuously though because I am by no means a legal scholar.
Regardless, I don't think such a law should be applied in this manner (whether it's legal or not), and I am ultimately against the death penalty in all cases.
Hope this clears it up.

Sounds like he's a stupid thug but did not actually kill anyone, nor threaten to kill anyone, or even rob anyone. He was just the chauffeur for the people who did. So the DP is not warranted, IMO. A nice, long jail term would suffice. But this is Texas we're talking about.

Well, I think I'm done defending this moron. I have beef with this law and with the death penalty, but those are different debates.
I'm curious as to why the other two people in the car didn't get the death penalty, btw. Does anyone know?Click here if you're having trouble sleeping.

the guy is guilty of aiding and abetting but to get the death penalty is a bit harsh. This is an abusrd case such as the one that occured in georiga and the blow job. Texas isnt the only ignorant state, they, all 50 of them , have their moments. When you find yourself arguing with an idiot, you might want to rethink who the idiot really is.

Well the 1st time you had glossed over the fact that they had robbed 4 people at gunpoint before meeting up with the eventual victims.FU, thats the 2nd time you accused me of lying without anything to back it up.I make no bones about my moral support for [terrorist] organizations. - chegitz guevara

Man, I totally missed that detail in the articles I've read so far. Linky?
If the guy was the getaway driver in robberies, and one robbery resulted in murder, he is usually also guilty under the felony murder law. A murder that results from the commission of a crime can be prosecuted essentially as murder. This isn't new.
Of course, when you say Texas is just randomly killing someone who is effectively just driving a friend innocently, you completely distort the debate.
This is why you need to provide info in the OP.

According to the testimony of the other people in the car, the driver didn't even know what the murderer was doing.
You ask what would I do if the gunman pointed a gun at me, I'd bail, let him take the car.Scouse Git (2) La Fayette Adam Smith Solomwi and Loinburger will not be forgotten.

The absurd suggestion you made is that Foster was blissfully unaware that he was the getaway driver in 4 armed robberies especially in light of the fact that I've seen no suggestion that he is mentally retarded. Then the person who suggested going around "jacking" people at gun point goes out just to "talk" to someone. Please.
Well the 1st time you had glossed over the fact that they had robbed 4 people at gunpoint before meeting up with the eventual victims.
