        Given that the murderer's testimony appears to have been contradictory, I'm guessing the jury thought that it was simply hard to believe that Foster wouldn't have known about the gun if they were driving around committing robberies.

          That was the testimony of others in the know, is this not a fact? Your quote from the killer didn't implicate Foster, it implicated himself and the other guy. The same people testified Foster didn't know Brown even had a gun.

          That dont make me a liar you jackass. But what in my OP has been refuted? You said the story was BS, and it aint BS. We disagree about the required evidence to convict and execute someone.

              Given that the murderer's testimony appears to have been contradictory, I'm guessing the jury thought that it was simply hard to believe that Foster wouldn't have known about the gun if they were driving around committing robberies.
              Where is the contradiction? According to the killer, they weren't even robbing anyone when the murder occurred. I've driven people around before without knowing what they were doing when they wanted to stop and get out for a few minutes. If Foster was in on the robberies then he should be punished obviously, but we dont exactly have enough evidence to draw that conclusion.

                We have testimony that says the murderer "announced that he had a gun" and that they should "jack someone," and we have testimony saying Foster didn't know about the gun. These are clearly contradictory pieces of evidence.

                          I think it was back in 1973, the Supreme Court outlawed the death penalty, unless there were findings of "special circumstances," such as lying in wait, killing a police officer, mulitple murders, etc.

                          At most, the driver violated the felony murder rule. But I see nothing indicating special circumstances. I don't understand how he could be given the death penalty.

                                oh good lord !!!! nice to know that a f#ucking 12 yo is running the site. Seems i havent missed a whole lot in my absence. But anyway, from what i understand the dude knew what he was into, this wasnt the first crime they commited that night. The death pealty is harsh like i said but it isnt any different then georgia giving 10 years to a guy for a consenting blow job. All i can say is that better have been a f$cking great blow job, and the guy driving better have drove like a bat out of hell grabbing himself a **** load of traffic violations to warrant the punishments.
