    I was just gonna say the same thing, and u have him on violating the lease by not paying all the renton time and even after the day that is was gonna be late. so this 3 day thing will help you more. The renters laws are so much differnt in texas, we can be locked out after being 4 days late on rent, as long as we are left with a notice of where we can get the new key and ways to get back into our home.
    I think that is more sensible.

    • OK, so dirt bag is saying he will pay me the back money he owes and the rent for next month together but not just the back money. If I accept next month's rent then it would invalidate the 30 day notice I gave him. I really do want him out and I want the back money. I can't refuse to accept the back money until the three day pay or quit has expired so I intend to just not ask him for it and see if he forgets.

        • Why can he tell you he will pay back money he owes and rent at the same time. Just tell him, give me the money you owe, I don't want you here anymore, I am not accepting rent for the month of December (or whatever).

          • Basicalyl if he writes a check for more than the ammount owed, refuse to take it.

            If he pays in cash, only accept the ammount owed.

              • I think it is better to get him out of there then to have a months rent.. even. He is obviously not only someone who doesn't take care of their responsibilities.. but is an active *******.

                  He'll be paying in cash. He doesn't have a checking account, I found this out far to late, because he has several creditors and the IRS after him and they have won court cases against him. His last checking account was frozen and then emptied by the IRS for failure to pay back taxes.

                  If he pays the back money owed then he's a dumb ass because I will just turn around and file an unlawful detainer based upon the old 30 day notice which was given.

                  • Cant u tell hm as the land lord you will only accpet payment in the form of a cashiers check? I do believe u have to have some type of an account at a bank to get one dont you, and if he cant secure a cashiers check then ur 3 day thing is still good

                      He's paying in cash right?

                      Tell him to bring the money first. No money no discussion. Tell him to pay you at such and such a day otherwise he is out. He's lied to you enough times that you shouldn't take him at his word that he has the money for even the stuff he already owes let alone anything extra.

                      Once he shows up with the money count the money and return to him what he pays over the money that he owes in back rent. You are not obligated to accept rent money for the following month regardless of his ability to pay.

                      Then file the unlawful detainer and get him out that way.

                        I could demand a cashier's check or a money order though I believe both are relatively easy to obtain. Walk into a bank with the cash and pay a $5 fee and walk out with a cashier's check. Money orders work the same except you walk into the post office.

                          • You might try a different approach. Remember that the sooner you get ride of him, the sooner you can rent out the place. Consider paying him to go away. Not merely forgiving back money's owed (but that should be a starting place for negotiations) but actually giving him money to agree to leave by such and such date (and hold on to all the money until he vacates).

                            I know this would seem like rewarding his bad behavior, but really what you want is him gone and someone else in his place and this might be the quickest way to make it happen.
