I agree . . . . but seizing a car can be tough particularly if its a lower value vehicle. The creditor claims they need it to get to work and the realizable value is so low that its just not worth it

Are you saying that it's unlikely the judge would go through with the seizure?

The reason the other 6 people who have won court cases against him in the last 4 years haven't seized the car is because it is a 10 year old Jeep which the dirt bag has treated like **** so it is in poor running condition, stinks of cigerettes, and has tons of burn marks from ashes. I know I wouldn't gain a penny out of the siezure but I am going to push to have it siezed so that he loses his set of wheels.

I want revenge.

From what Flubber was saying it sounds like the seizure might not go through, but it's worth a try.

You're right. It is very hard to get a judge to agree to seize a car because the defendent will say he needs it for work. My argument is this scumbag has been sued six times before me in the previous four years and that I am unlikely to get any of the awarded monitary damages paid therefor; he is after all in default on every single one of those cases. Therefor the only possible remedy to solve this in a timely manner would be to seiz his assets and sell them at auction.

At least I will argue that. Like I said it is unlikely I'd get any money out of it since the lein holder would get first dibs but it would screw dirtbag over royally especially since he had crap credit and so can't get another car loan.

And you're not going to get anyting out of it except a feeling of revenge that he may end up with the last laugh if he returns the favor.
Earlier in the thread you will willing to bribe him just so he'd leave. Since then you've gotten a lot more tense about it. I know he's played a role in that, but in the end, won't you just be happy to see him gone.

No reason to be as big of a jerk as he is. It could have consequences.

I've spoken to my father and he will be coming over to my house for dinner tonight. We'll both be there waiting for dirtbag when he comes home and that way my father can serve him with the summons and I can be on hand to witness it.

I will defer the decision on what to seize until after I have won the case and dirtbag has failed to pay me (as he has failed to pay everyone else).
