You can simply only accept the amount of the back payments, and tell him he is not welcome here next month and therefore you do not want and will not accept rent for next month...

I'm not 100% sure about how legally to deal with that, though, if he hands you a check for (back + rent) ... you may be okay if you just write him a refund check for the balance immediately. You probably have to accept the (back+rent) check though (or choose to ignore the pay or quit).

Update: On Saturday I had him served with a 3 day pay our quit notice for the back money he owed me. That night he offered to pay part of the money ($60) and said he needed more time to come up with the rest. I declined a partial payment and said I'd talk to him when he had the whole amount owed. Last Sunday I offered to wave the $100 late fee for the month of Nov if he moved out by the 1st of Dec (which would be the final day of his 30 day notice) and he accepted though to date I haven't seen him pack anything nor has he mentioned that he's found a new place.

Officially the 3 day pay or quit notice runs out at midnight tonight so I can file an Unlawful Detainer suit against him tomorrow morning (which I will be doing) if he doesn't pay. That gets the ball rolling in court 5 days sooner then waiting for the 30 day notice to expire (since his official last day to move out is on a Friday and the court is closed on the weekend). Maybe he was being honest about moving out and maybe he was just BSing to gain some more time but either way I will be filing and if he does move out on the first then I can drop the case but if he doesn't then that's just 5 fewer days I have to put up with his ass.

I personally do not believe he will move out on the 1st like he has said he will. I believe he's just playing for more time. I will know for sure by the end of today.

Yes, in deed. I decided to try Che's approach and offer to wave $100 of what he owed me since it would cost me at least that much to file a court case against him. If it works then I'm no worse off but if it doesn't then I can honestly tell the judge I tried to be very reasonable.

Well, he didn't pay yesterday so the 3 day pay or quit notice has now expired. I still haven't seen him pack a thing nor have I heard him mention he's secured another place. I've tried calling him this morning but he didn't pick up the phone; likely because he saw it was me.

I will try to call him one more time then I will go down and file the unlawful detainer law suit.

It has come to a head and now the law suit will go forward. I called James five times today and he kept avoiding my calls; finally at 12:30 he called me back and I was very nice but firm. I told him I had a bunch of boxes at work which I could bring home if he needed packing boxes and asked him how things were going. James told me he didn't need any boxes then said he thinks he found a place but he can't move in until the middle of the month or the beginning of January. I told him his 3 day pay or quit expired yesterday and 2-4 weeks just wasn't good enough. I informed him that I would be filing an unlawful detainer case against him today.

Now I'm off to file the case.

This Oerdin dude is not someone who you'd like to stay with, let me tell you about it! He's been sticking papers on my doors and shoving them here and there and he's a pain in the butt!

And why is that? So I was a little late with payment, so what? Since when do you evict people for that? Ethiopia has a huge debt and did anyone throw them out of Africa? Didn't think so.

I've hired an attorney and I'm going to sue for mental distress, breach of contract, neglect, harrassment and stuff.
