This case is utterly tragic. I cannot help but come down on the side of caution. Her husband has one million in the bank from a malpractice award that was supposed to be used to help Terry. Instead, when he got the award, he immediately began his attempts to pull the plug. This, coupled with the fact that he has moved on to another "wife" should disqualify him as being her guardian henceforth on the basis that he is her "husband." He has acted against Terry's welfare in attempting to preserve the million for his own beneftit. This is a manifest conflict of interest.
A Mayo Clinic neurolist is now testifying at the Federal District Court that Terry is minimally conscious. Her nurses say thats he can talk and that she can swallow. They say she tells them when she is in pain from her montly cycle. She says the word "pain" clearly enough to be understood.
She is alive and conscious and may, with therapy, be able to eat on her own. She certainly communicates with her parents in a manner sastifactory to them.
Were she completely unconscious, my opinion would be different. But, this is not such a case. If she has left a written a living will that clearly indicated her wishes in these circumstances, my opinion would be different. But, this is not such a case. If her desires to die were clearly established by witnesses who had no conflict of interest, my opinion would be different. But, this is not such a case. Were her family be united on the decision to pull the plug, my opinion would be different. But, this clearly is not such a case.
I have a daughter. I have been thinking that I might ask her to sign a power of attorney appoint me or my wife as guardians as opposed to her husband if such sad circumstances would ever to befall her. Guardians are supposed to have their wards' best interests at heart. Husbands, sadly, apparently have inherent conflicts of interest that prevent that.
I would also support legislation to this effect as the default rule in cases like these.http://tools.wikimedia.de/~gmaxwell/jorbis/JOrbisPlayer.php?path=John+Williams+The+Imperial+M arch+from+The+Empire+Strikes+Back.ogg&wiki=en

Incorrect. It was 5 years after he recieved the award that he asked the court to pull the plug. And who paid the medical bills? The $1 million is gone.

Link? I've heard enough BS that I don't believe that Terry can talk at all. Her frontal cortex is gone.
She is alive and conscious and may, with therapy, be able to eat on her own.
When just about every neurologist out there says this is impossible, I'd choose to believe them.“I give you a new commandment, that you love one another. Just as I have loved you, you also should love one another. By this everyone will know that you are my disciples, if you have love for one another.”

#1, I'm not afraid of Mike. I am glad to have him back. No one writes with quite the flair he does; his last turn phase in particular made me laugh. Doesn't mean I agree with his take; I've just exhausted all reserves of "my precious gives a ****."

You are correct. In the five years before he asked to pull the plug, he limited himself to placing a do-not-resuscitate order on Terri and denying her treatment for a potentially life-threatening bladder infection. She probably would have died then if the folks at the nursing home hadn't rebelled...KH FOR OWNER!

Imran, check out the news on TV. I got this report about the testimony at the Federal hearing now being conducted from MSNBC.
As to what the nurses said about Terry, I they have been all over TV. Are they lying? Why would they lie?
As to million, what you say about it being gone is apparently incorrect. The money that Michael has spent from the million has not been spent in an effort to rehabillitate Terry, but is instead being used on lawyers to terminate her life; although it is also clear that Michael is being helped with his legal fees from other interested organizations as well.http://tools.wikimedia.de/~gmaxwell/jorbis/JOrbisPlayer.php?path=John+Williams+The+Imperial+M arch+from+The+Empire+Strikes+Back.ogg&wiki=en
