    • There are two facts that bear repeating in this thread:

      1) MS is stupid to require the Kinect
      2) People are stupid for being upset about the Kinect spying on them

      • It might be slightly paranoid, but I really don't agree with #2. Given recent news, it seems relatively reasonable to be concerned about the Kinect.

          Nope.

          Recent news was bad reporting from a bad newspaper (WaPo).

          Kinect does not and will not transmit its activities outside of the home, nor does it record.

          Recent news was that the US gov't demands data regularly from tech giants and telecoms. And for some reason Verizon has to give all call metadata (not the call contents themselves) to the US government, which is indeed bizarre.

          These are two entirely distinct spheres. That would be a valid point if MS transmitted all data to their servers, logged them indefinitely, and gave the NSA free roam to do whatever they want with it. All three of those things are ridiculous.

          • As I have said, I am not personally concerned with the government looking at my living room; however, I am concerned that Microsoft wants to put a camera and microphone there, for reasons that defy explanation, and there is no guarantee that their security is up to snuff to keep some other bad actor from accessing such.

                It's also clearly totally unconstitutional, but until now court challenges have been impossible since you couldn't actually prove in a court of law that your metadata was being searched.
                If there is no sound in space, how come you can hear the lasers?

                • As for spoofing the camera, I promise you it can be done. Maybe they will care so much that the glass of water won't cut it. But I doubt they're so invested in it to prevent that.

                  • The problem is that once the hardware is there, the software will follow. Given Microsoft's control over the XBox software ecosystem I'm not terribly concerned about third parties. However, there have already been demonstrated cases of roving wiretaps activating in-place hardware transparently on both cell phones and computers. Why would the Kinect be any different? It is a network-connected device that already has the ability to listen when it claims to be "off" (thus the "xbox on" command). It wouldn't be hard to extend that ability to upload audio.

                    That said, the privacy concerns are just a small part of how Microsoft completely screwed up their console this generation.

                            • Fact is, when you ******s send an email or place a phone call, you are telling your private phone provider that you are doing so. You are not having sex in your bedroom, or murdering your unborn son because you can't afford a baby, or writing a note in your personal diary that you keep in your pocket at all times. You are involving a third party in your communication, and abandoning your reasonable expectation of privacy to the fact that you placed a call at that time.

                              • That's goose **** because your provider is not the government and the government can abuse the knowledge of knowing about every call and every message you made someone else. Preventing abuse of that kind is the whole point of some many aspects of your constitution and if that constitution isn't capable of stopping such surveillance then it ought to be amended.
