This is Texas you're talking about. She's fine legally. Breaking into a dwelling while the occupant is home seems like a substantial threat in any event.

Someone forcibly entering my place of residence will be shot. If they die, they do. I'm not going to try and wound them. I'm aiming dead center so that I should hit something.

As far as I know BK doesn't support capital punishment for thieves.
