    At least you use terms like "I think" and "I don't understand" to show that it's just your opinion and not necessarily fact.

      It's easy to argue. I consider a baby in the third trimester a person but not one in the first trimester. IT"S ALL A MATTER OF OPINION which means it's suitable to argue.
      Which means that the standard is completely arbitrary. Roe is untenable as written. They have already had two decisions to try to 'save' roe, which did away with the third trimester provision.

      You are aware, rah, that a woman could cite the fact that her pregnancy makes her feel bad and have a third trimester abortion?

        When the authors of Roe say that it's bad law, I'm not sure why anyone sides with it. It certainly doesn't help the case of abortion supporters.

          The fun part of the substantive due process clause is that its been used to knock down laws that conservatives would find abhorant as well.

          After all without it, Pierce v. Society of Sisters wouldn't have been decided as it was and states like Oregon could have had manditory public schooling laws.

            I'm not saying what is right. It's just my opinion, that I"m not going to JAM down someone else's throat.

              And that would be her opinion too, and just as valid as yours.
              It's not an opinion, it is a fact. Legally, emotional distress can be cited as a reason for a third trimester abortion. So essentially, there isn't any abortion which is banned.

                emotional distress has nothing to do with the definition of when a baby becomes a person. SO WHAT FACT ARE YOU TALKING ABOUT?

                  That the current legal interpretation permits third trimester abortions for health reasons, including emotional health.

                      And I have no problems with that but it has no relevance to my opinion that for me, a baby probably becomes a person during the third trimester. But as I said, just my opinion. Others feel differently, (even you) and they're entitled to their OPINION.

                              It wouldn't be arbitrary for someone to say personhood begins when the brain starts functioning, and that they are certain that fetuses don't have any sort of brain function during the first trimester. And I'd say every definition of personhood is somewhat arbitrary, including those that imply life begins at conception.

                                Now, it's just me, I don't think you really believe that third trimester unborn children are persons because otherwise it would bother you that other people kill them.
