But I think it's high time for some reciprocity from our friends in the Democratic party. I think they owe us a Souter in reverse. That is, President Obama should nominate someone who is a virtual unknown, a cipher with no paper trail but a reputation as a "moderate" in Democratic party ranks, capable of assuring liberal senators that he has no problem with judicial lawmaking as an abstract proposition, but who turns out within the first term or two on the Court to have been a closet originalist, devoted to judicial restraint, and who "grows into office" as a stalwart ally of Scalia, Thomas, Roberts, and Alito.
Democrats can't even be bothered to nominate thier own Souter out of fairness.

thats not how it really works, the SCOTUS reversed something like 3 (or 6?) of her decisions out of hundreds. The court usually agrees with appellate decisions and never takes up those cases allowing those decisions to stand as is, but sometimes they see a problem or want to clarify something, maybe even a bad decision. The SCOTUS reversed %100 of Alito's decisions, that really dont tell us much. How many decisions were reversed, not the % of decisions. If a judge has dozens or hundreds of decisions reversed then that may be a problem. Personally I dont see anything wrong when a judge's decision is reversed by the SCOTUS, if James Madison himself was alive today and actually got nominated (a snowball's chance in hell) the Demrats and the Repugs would kill the nomination because they dont want the Constitution getting in the way of their agendas. By definition the SCOTUS is made up of people who are unqualified because the people nominating and confirming judges dont want people who will enforce the Constitution...Originally posted by SlowwHand View PostComment
