In absence of a clear statement in the US Constitution authorising the Federal judiciary to throw out the acts of coequal branches of government, the arguement for such a power seems to rely on a signifigant amount of glossing over and ignoring the text one is seeking to defend. Hey plenty of the authors of the document had a living document idea of it. Hamilton, for one, was very into implied powers. As I said previously, only Alito, Roberts, and Scalia (my favorite) had experience in all three areas so I deem them best qualified.

Sotomayor has no academic credentials which puts her in the group with Souter and Thomas.
