                        Apparently some Russian parliamentarians say its not unconstitutional, its just not mandated, its up to the govt.

                          From my research (on russian sites as well as english ones) Litvinenko did serve in the FSB in the counter-criminal special unit.

                          And the VV (vnutrenie voiska) are practically an MVD militia, so his relationship with state power structures is not weakened at all, especially if he was somehow a VV spentsnaz.

                          Do you have sources in Russian I could read to substantiate your POV?

                          Admittedly most of what I read is anti-putin. To me it seems much closer to objective that the Moscow spin though.

                          And I'm usually good at recognizing active measures.
