AAAAND, the idea seems silly. How could it not be criminal? So if it's not criminal, how exactly does it work? We write Juan Salazar a ticket for being an illegal that he will never have to pay because we can't track him because he doesn't have real documents? The next time, what happens? They are all grouped under heading of 'Criminal offenses' or 'Criminal law' (for ease of use), but not all violations of a law are 'crimes' [think of people using the term 'assault' for the act of getting hit]
But not all breaches of the law are considered crimes, e.g. breaches of contract. The label of "crime" and the accompanying social stigma are usually reserved for those activities causing more serious loss and damage to the citizens of the state
