It's a deterrant. Yes we know everyone uses it as revenge. But I feel it has a minor deterrant effect.

If you're crazy enough to kill someone considering the punishment of dying versus getting locked up for life hardly enters into the equation.
What's ironic is that there is a bill going in for review January that will pause the death penalty in California while it is up for review as to whether to continue it or not.
Tookie's murder will pretty much give this bill the attention it needs. He may even be the last man to be executed here.

The people who claimed he had been rehabilitated are either liars or completely ignorant of the facts. Tookie reportedly continued to hold a leadership position in the Crips gang ordering informants stabbed to death and was himself found to have had a "shank" or home made knife in his cell. He repeatedly assualted guards and other prisoners nor did he ever agree to help authorities break the crips gang nor testify against his fellow gang members even when they offered to reduce his sentence if he did.
The people who claimed Tookie was not a threat to society or that he was redeemed by writting a children's book are simply wrong.

Most of these gang members aren't murdering people out of passion. They're making a cold blooded judgement to kill someone in order to make money via control of the drug trade or other illegal activities. Sure, not everyone will be detered but even if just one person is detered from doing what Tookie did because of Tookie's death then the execution does have a deterent effect.
and I believe death does deter some of them. Though not Tookie. He seemed pretty calm last night. Getting locked up is nothing for these guys. They keep their status even while in prison. In fact most don't get any respect until they've done some time.

He doesn't get to decide to kill someone the courts didn't want to. He gets to deliver mercy where it might be deserved. It is a good system if one is to have a DP.

Another way to punish them is to humiliate them. Dress them up in ballet suit and make them walk down main streets doing a ballet dance.

I'm highly disturbed by the local media coverage of this (Chicago). Basically it has been "Stan might not be guilty", and not "This guy is responsible for dozens of murders and helped found one of the biggest gangs out there". Reformed or not, he committed horrible crimes against L.A. and this nation, and deserves to be punished.
Isn't association a right, and not a DP crime?
I think the crux of the issue is whether he was guilty of the crimes he was convicted of beyond a doubt that goes beyond what your courts consider, and did he ever express remorse beyond writing a couple of books.
