  • Ahh pedantry. Can't honestly say it bothers me, he was still asking for it.

    And people wouldn't have been able to hear the iPod, "full volume" was a little exaggerated and I use externally quiet Sony headphones which are less conspicuous than Apple's white ones.

              Im not easily offended so if they want to talk loud thats their business but we arent talking bout me. Some folks dont want to hear a couple of friends talking loudly bout their night before. Secondly i have never rode a bus with a friend. I have only rode the bus when i was in hawaii and at times two folks talking very loudly in a foreign language did get annoying but i had my own cd player so i usually put it on and sat there in obvillion.
              Whale boy did start the fight he got up and confronted the guy in a violent manner when he could have simple told the guy to put the cig out. But instead he chose to knock the cig out of his hand and strut off. And where I come from thats called assault.

              • You're probably one of those people who defends kids who cause a nuisance around people's otherwise peaceful homes, and says that it's "assault" to give them a clip round the ear .

And I also said the guy was inconsiderate for lighting up where he shouldnt have. A dirty look shouldnt demand a person jumping up to hit you.                         I didn't just jump to my feet and "assault" him, there were plenty of dirty looks being exchanged, and you'd think the phonecall was enough of a hint.

                        I'd say being in much discomfort because another person is being inconsiderate makes it "my own ****ing business".

                        • Btw, before trying to use law terms, it's best to realize what they exactly mean . What Whaleboy did was battery, not assault.

                          • Btw i know the defenition imran according to my cla manual the def of assualt can be either an attempt to commit batery OR the intentional creastion other then by mere words of a reasonable fear in the mind of a victim of imminent bodily harm so in actuality he did both commited assault and battery

                            • I must add in case u werent aware i have been studing to become a paralegal. After 6 months I know Im not lawyer and dont want to be one but im a bit familiar with the laws

                                You have been using 'assault' as to him hitting the person's cigarette and kicking him. Both of those are battery offenses. Those would be examples of battering him. Assaulting him is his apprehension of getting hit. That isn't clear at all because it sounded like he flicked the cig away real quick and he kicked the guy while the guy's back was to him. Who knows if the guy was afraid he'd get hit. Though it's clear he was.
