                      • Burress Arraigned on Gun Charges

                        Giants receiver Plaxico Burress was arraigned Monday in a Manhattan criminal court, charged with two separate counts of criminal possession of a handgun in the second degree after accidentally shooting himself in the thigh three days ago at a Midtown nightclub.

                        He faces a mandatory sentence of 3 ½ years in state prison, with a maximum of 15 years, on each count.

                        Burress, who caught the winning touchdown in the Giants’ Super Bowl victory in February, remained seated on a bench at the back of a courtroom while waiting to post the $100,000 bail, cash or bond, set by Criminal Court Judge Felicia Mennin.

                        The judge denied a request by Burress’s lawyer, Benjamin Brafman, to allow Burress to be released for 48 hours to post that bail. She then ordered Burress to return March 31.

                        Brafman, who has represented high-profile clients like hip-hop star Sean Combs, had said that Burress would not flee the jurisdiction partly because he would forfeit the right to continue his $35 million contract with the Giants.

                        “There’s no place for him to run where he would not be recognized,” Brafman said, to no avail.

                        After a long day — during which Burress spent about five hours at the New York City Police Department’s 17th Precinct station house, where he likely posed for mug shots, was fingerprinted and sat for interviews with detectives — details of the shooting became clearer.

                        The police said that Burress arrived at the Latin Quarter nightclub in Manhattan on Friday at 11:30 p.m. with four others, including teammates linebacker Antonio Pierce and Derrick Ward. The other two members of their party were not football players, according to police. At 12:05 a.m., a single gunshot is heard.

                        The criminal complaint, released by prosecutors Monday, said that an onlooker saw Burress near the V.I.P. area of the club holding a drink in his left hand and fidgeting his right hand in the area of the waistline of his pants. The witness then heard a single “pop” sound before hearing Burress say, “Take me to the hospital.”

                        Burress was on the ground, with his legs shaking, when a bloody gun — a .40-caliber Glock pistol — fell out of his pant leg and onto the floor, the onlooker said.

                        Later, Burress, who does not have a permit to carry a handgun in New York City, was treated and released at a hospital before returning to his home in Totowa, N.J.

                        On Monday, Mayor Michael R. Bloomberg harshly criticized Burress for carrying an illegal handgun; New York Presbyterian Hospital for failing to call the police of his gun-related injury, as state law requires; and the New York Giants, which also neglected to notify the authorities.

                        “Our children are getting killed with guns in the streets. Our police officers are getting killed with guns in the hands of criminals, and because of that, we got the State Legislature to pass a law that if you carry a loaded handgun, you get automatically 3 ½ years in the slammer,” Bloomberg said, speaking to reporters following an announcement about the expansion of job placement services in the city’s workforce centers.

                        “I don’t think that anybody should be exempt from that, and I think it would be an outrage if we didn’t prosecute to the fullest extent of the law, particularly people who live in the public domain, make their living because of their visibility; they are the role models for our kids.”

                        Bloomberg said that the police did not find out about the incident until it was reported on TV, and that the Giants should have immediately notified the authorities of the shooting. He said the team had a responsibility to do so if their players want to be role models to the public.

                        “We are working closely with the police and N.F.L. Security,” said Pat Hanlon, the Giants’ spokesman. “In the early hours of Saturday morning, as we started to get a sense of what we were dealing with, we did, in fact, notify N.F.L. Security, which then contacted the police.”

                        Bloomberg also criticized the hospital for failing to call the police.

                        “I think also it is just outrage that the hospital didn’t do what they’re legally required to do,” he said. “It’s a misdemeanor, it’s a chargeable offense and I think that the district attorney should certainly go after the management of this hospital.”

                        What started out as a night out drinking at the Latin Quarter nightclub with two teammates, including linebacker Antonio Pierce, has turned into a nightmare for Burress, who is facing a possible prison sentence and also punishment from the N.F.L. A law enforcement official said Pierce was being investigated for his role in the shooting.

                        The gun, a Glock semiautomatic pistol, was recovered at Burress’s home in Totowa, N.J., the official said.

                        It was unclear Monday whether charges would be filed against Burress in New Jersey, where he lives and where the gun was recovered from his home.

                        Robert Coyle, chief of the Totowa Police Department, said a search of Burress’s home did not turn up any other weapons. James F. Avigliano, the Passaic County Prosecutor, said his office was in touch with the New York Police Department and the Manhattan District Attorney’s office. He declined to comment further on the case.

                        In New York, according to state law, a person carrying a gun without a permit faces at least 3 ½ years in prison.

                        Under the league’s personal-conduct policy, violations of local gun laws can result in a player’s suspension.

                        “We are cooperating with the police and continuing to monitor the situation,” the N.F.L. spokesman Greg Aiello said.

                        Burress’s lawyer, Benjamin Brafman, emerged from the station house this morning after Burress’s arrival and said his client would “deal with the legal process in a responsible and professional manner.”

                        “He is standing tall,” said Brafman, who has represented high-profile clients, including rapper Sean Combs in his 2001 bribery and weapons case. “He’s a mature adult handling this very well, I think, under the circumstances. He has asked me to tell all the fans who’ve written and called, and his teammates, that he very much appreciates their expressions of concern.”

                        Pierce played in the Giants’ victory against the Redskins on Sunday. Burress remained at home inside his sprawling estate, tending to his injury, though he was not scheduled to play in the game anyway because of a hamstring strain in his now-wounded leg.

                        Officials from the league and the Giants have yet to determine what, if any, punishment Burress would receive as a result of the incident.

                        Brafman said Burress held a gun permit in Florida. Online records show that the permit expired May 21. Even if it were renewed, it would not matter. According to New York law, one must hold a New York gun permit to carry a concealed weapon in the state. Burress does not.
                        The mayor and police criticize the Giants receiver, who could face 3 ½ years in prison for possession of a handgun, the team, the N.F.L. and the hospital that treated Burress.

                              I didn't watch the game, but what I've seen from the stats is that Norv just worked himself out of a job.

                              Won't be too soon. Another less then a TD loss.

                              This team has had issues since day 1. I was hoping they could overcome their issues, but it looks like Norv really was a loser.

                              Now, we'll be looking for a Head coach and an OC back again. Cam Cameron would make a decent Offensive Co-ordinator, and I think Billick is their best choice for a HC, assuming Wade stays on.
