                  The interesting thing about this case is that it's not a constitutional case at all, and not really as political as the others. The case is about overbroad interpretation of the statute by the IRS. Basically, the law allows for subsidies and penalties on the state exchanges (that mostly don't exist) but not the federal one, yet the IRS is applying them to the federal one where the law doesn't allow for it.

                  However, since the state exchanges don't exist, if the subsidies are cancelled on the federal one the law falls apart.

                  If that's true it's probably not due to obamacare since most of the mechanisms for increasing insurance coverage haven't been implemented. Employer mandate is in a state of permanent limbo and likely to get repealed. The individual mandate is not significant enough a penalty to matter. Many (most?) states haven't implemented the medicaid expansion. If this case succeeds, the subsidy disappears too in 36 states.
