      I'm intrigued by how the New Mexico court contorted itself to prove that photography was not 'expression', and conveniently exclude photographers, bakers and florists from first amendment protections. Seems like an unenforceable provision.

      If the photographer were to brand herself as a 'wedding historian', and produced 'wedding packages', that included a record of the wedding festivities, including a photo and captions, would that still not be considered 'expression'?

            A) That's apparently not true.
            First amendment makes no distinction between photographers. Amendment > New Mexico law where they conflict.

            B) The issue here seems to be that she was too honest in turning them down. If she had simply said it was due to a schedule conflict, I doubt a court case could have been filed.
            The law is so poorly worded to be unenforceable. The first sign is when they carve out convenient 'exceptions' for first amendment protections that have no bearing in constitutional law.

            The best way to challenge this law would be to challenge the 'expression' provisions. In this example, a photographer putting together a 'wedding packet', with included captions. Is such not expression?

              Well, let's be fair, that's been the case for refusal to serve based on race, religion, etc, etc. for a while.

                              Because it's never that simple, and a quick glance at history should tell you that. What happens when you're born gay in an area where no businesses want to provide services to gay people? Do you not also think that kind of environment might go some long way to feeding into a culture of discrimination and hate against homosexuals? Hell it did with blacks for long enough.

                                In other words, much as you might find this case unfair on the face of it, Kid, it is foolish and callous to dismiss the context of the unfairness it attempts to address. That context was not invented by Al Gore to make money.
