Sure this sets the precedent for the Republicans to kill whatever remains of the filibuster when they take back the Senate BUT:
1. It's not as if the filibuster ever had much effect on Republicans getting their people confirmed. Bork wasn't filibustered, Thomas wasn't filibustered (the Democrats could've stopped him that way and didn't) and the judges that were filibustered under Bush II pretty much all got through under the Gang of 14 deal.
2. **** the filibuster. If you win elections you should be able to put your policy into effect. The US Constitution has enough veto points without making it even harder to get stuff done. Westminster systems are looking more and more appealing to me for precisely this reason, in those systems if a party has a majority and bad stuff happens you can clearly point out who's to blame, while in the US system power is so divided that it's hard to know who to blame when stuff goes wrong which makes it harder to discipline politicians for doing dumb stuff via elections.
3. Does anyone seriously think that the Republicans wouldn't have nuked the filibuster the second it got in their way when they retook the Senate ANYWAY! Threats of "now we're going to do what we would've done anyway!" ring pretty hollow. Most of the Gang of 14 is gone and do you really think that there would be many Senate Republicans who'd stick out their necks to make that kind of deal if the Republicans take the Presidency and Senate in 2016?
4. Although the Republicans have a very good chance of taking the Senate in 2014, the map is terrible for them in 2016, as long as they don't have big presidential coattails in 2016 they'll lose seats then. I'd say the chance of a Republican president and Senate being elected in 2016 are pretty low.
5. This actually gives cover to red state Senate dems. Now that only a simple majority can get judges through, red state dem Senators will be able to vote against liberal judges without stopping them from being confirmed and they can make a big empty show over how moderate they are, has to be worth at least something...

Not true. Bush II had 52 nominees blocked through the filibuster and eventually filled half of them. 20 of the Bush vacancies have been filled by Obama nominees. The Gang of 14 deal got some through, not 'almost all'. Half.
