Zimmerman lawyer to move ‘asap’ against NBC News

By Erik Wemple, Published: July 14 at 12:15 pmE-mail the writer

Last night’s not-guilty verdict in the George Zimmerman trial will enable the neighborhood-watch volunteer to resume his case against NBC News for the mis-editing of his widely distributed call to police. Back in December, Zimmerman sued NBC Universal Media for defamation over the botched editing, which depicted him as a hardened racial profiler.

    • Civil rights case vs. Zimmerman won't be simple

WASHINGTON (AP) — Calls for the Justice Department to look into the shooting death of Trayvon Martin reverberated as soon as George Zimmerman was acquitted of state charges in a Florida courtroom, but it may be even tougher to mount a federal case against Zimmerman.

The department says it’s reviewing evidence to determine whether criminal civil rights charges are warranted, but legal experts see major barriers to a federal prosecution — including the burden of proving that Zimmerman, the former neighborhood watch leader, was motivated by racial animosity — and say Justice officials would likely be saddled with some of the same challenges that complicated the unsuccessful state case.

‘‘The Justice Department would face significant challenges in bringing a federal civil rights case against Mr. Zimmerman,’’ said Alan Vinegrad, the former U.S. Attorney in the Eastern District of New York. ‘‘There are several factual and legal hurdles that federal prosecutors would have to overcome: They'd have to show not only that the attack was unjustified, but that Mr. Zimmerman attacked Mr. Martin because of his race and because he was using a public facility, the street.’’

The department opened an investigation into Martin’s death last year but stepped aside to allow the state prosecution to proceed. It said in a statement Sunday that the criminal section of its civil rights division, the FBI and federal prosecutors in Florida are continuing to evaluate the evidence generated during the federal investigation, plus evidence and testimony from the state trial. The statement came as the NAACP and others called on the Justice Department to open a civil rights case against Zimmerman for the shooting death of the unarmed black 17-year-old.

Feel free to go **** yourself. It's just a shame a few more of you don't apparently give a damn about kids getting shot to death in the street.
Did you just prove his point?

        • does anyone know if a conviction would doom Z's lawsuit vs NBC?

if true, would that mean NBC had a motive to RR Zimmerman?

          • does an acquittal strengthen a slander lawsuit vs NBC or would it matter?
            What specifically did NBC do?

            • Oh, they edited the phone tape. I remember.

Yes, an acquittal helps Zimmerman tremendously. The key component of civil suits for defamation is showing damage to reputation. Part of why Asiana Airlines' suit against that TV station is retarded is that no one seriously thinks those jokes damaged their reputation more than their pilots' decision to crash a 777 into a ****ing seawall.

Similarly, NBC could have pointed to a 2nd degree murder conviction as evidence that Zimmerman has no reputation to protect. He would have pretty well ruined it himself. Now that is not the case, so NBC needs to uh..settle. Fast.

              • I am wondering if Zimmerman is going to sue NAACP too. Some of what they are saying amounts to defamation as well. They are simply inventing the idea that he killed Trayvon in a premeditated manner.

I've mentioned before, I avoid the US and I'm a middle aged white guy. In the last 30 years, your nation has turned into an armed camp and some of you asses are actually proud of how dysfunctional your nation has become. Why don't the real majority of Americans stand up to the idiots who want to bring down any form of government and rule of law from within?

I'd feel unsafe as the result of this trial, stand your ground or no. That a black teen can scare a white guy into legally justified homicide is scary as **** as a black person. The fact stand your ground exists and it disproportionately hurts minorities is just icing on the cake.
