You know why attorneys make the outlandish arguments they sometimes do? Because once in a while, they actually work.

Anyway the Jury does not have to say why it acquited and there were other issues in the case. There was significant evidence that the victim died of medical malpractice occuring months after the wouding, and the prosecutors may not have gone for allowing lesser included charges after upgrading the initial charges to murder. Without a juror voluteering to be interviewed, there is no way to tell if the Castle Doctine entered into the verdict at all.

Stay out of my life, that's not up for discussion.

And, as my wife says, what does that have to do with the price of tea in China?

          ACK!

Lawfully this woman was a guest into his apartment, and even if she stole from him, that doesn't justify shooting her. There was no trespass.

Whomever was the prosecutor here did a terrible job.
No one said anything about a guest, you idiot.

Not after seeing evidence that he shot the tire not her. Reckless Endangerment, maybe. Murder? No.

Nobody said anything about the Castle law either. I'm still not sure why it's relevant in this case. Shooting and having the shot splinter and hurt the girl, isn't going to put the guy away for Murder 1 in any circumstances. The Jury did it's job. Is he saint of the day? No. Is he a murderer? No.

He shot Frago too, or else a bullet wouldn't have entered her body.

Gilbert said, "The wheel is here, the bullet is right in front of it, which is where all the curves of the metal and so it hit that and went into two pieces and the other one literally the size of your fingernail, went into the back seat."
                        Not so.

Prosecutor overreached. With this evidence, there's no way he would have gotten Murder one.

Castle doesn't apply to someone in the process of committing a crime. Solicitation is a crime. Ergo in this case Castle doesn't apply. He wasn't acquitted because of Castle, he was acquitted because the facts don't support murder 1.

You know, there are escorts who are just that, escorts. They're not prostitutes, they're girls you hire to take to a party or whatnot so that people don't think you're some sort of loser. When the person who hires them tries to take advantage of them they're supposed to tell him that sex isn't part of the deal and leave. In this case was there any evidence that such wasn't the case? How did he find her? Did he pick her up off the street or did he call an escort service?

Some time ago I pre-ordered a CD from Barnes and Noble. I paid for the CD in cash. Subsequently Barnes and Noble decided that they wouldn't carry that CD. When I went to the store the manager acknowledged that Barnes and Noble owed me money, but he refused to pay me because the store couldn't refund cash. I never got my money back. Would the state of Texas allow, no, I dare say mandate, that I shoot the store manager for this theft?
"I say shoot'em all and let God sort it out in the end!
