[The court] should not overturn the long-standing rule in Colorado that the term ‘person,' as is used in the Wrongful Death Act, encompasses only individuals born alive. Colorado state courts define ‘person' under the Act to include only those born alive. Therefore Plaintiffs cannot maintain wrongful death claims based on two unborn fetuses.

They didn't make a moral or doctrinal argument. They argued the definition under applicable law.

What this case does do is illustrate one part of the can of worms opened by fully defining legal personhood to go all the way back to a clump of cells that haven't even implanted in utero.

As the PR indicates, the legal position of the Catholic hospital indicates that most people feel they are being hypocritical in their moral position. It doesn't matter how exactly they are arguing it, it matters how it is perceived.

Hypocrisy in the Church? Lions and Tigers and Bears, oh my!

That's because most people don't understand the nuances, especially when it comes to law. They should blame the lawyers. The lawyers could issue a press release about how they are stuck between a rock and a hard place, because if they admit the Moral Truth(tm), they violate their obligations as lawyers and could be disbarred, or sued for malpractice, because it is the evil, baby-hating legislature and judicial system in Colorado who forces them to adopt this definition straight out of Satan's little minions from the Evil Sodomite Agenda(tm). Hypocrisy is why God invented spin.

Who'ld have guessed there is a gap between lawyers (legal arguements) and morality.

I was watching the news last night and it seems that the Church is going to review this case and make sure that any sponsored organizations adhere to Church doctrine. I imagine that the review will be complete sometime after the hospital wins its final appeal. If they do decide the hospital violated doctrine, I wonder what their "Christian" response to father will be?
