To be fair the whole background check bill is kind of hamfisted.
In particular, the kind of private sale that criminals tend to get their guns was protected and required no background check under the legislation. Not that it would matter anyway. How you would stop two people from meeting and discretely exchanging a small object without calling the ATF background check line is beyond me.Comment

That is a true, but it will always be true. There will never be a way to stop that sort of transaction. That fact, however, does not mean it is useless to try to close other loopholes.
