  • Wonder if Ben as a good catholic pays his tithe and if he considers it as robbery
With or without religion, you would have good people doing good things and evil people doing evil things. But for good people to do evil things, that takes religion.

Beyond Woodrow Wilson's desire for more money, what's the constitutional basis for federal income taxation?

Ah, so Constitutional amendments don't count as being part of the Constitution? Time for a federal ban on handguns and Catholicism.

            • I suppose that revoking a woman's right to vote would appeal to your ultra-orthodox Catholic sensibilities, so I can see why you would arbitrarily and idiotically reject Constitutional amendments as being unconstitutional.

Well first, an ultramontanist would be opposed to democracy in general as well as to a written constitution.

Second, I'm hardly ultra-Orthodox. I'm a convert. I've never been to a Latin mass. At best I'm an orthodox catholic and on the liberal side of that spectrum.

I simply haven't put the hours in that others have. I'm coming up on 6 years now which is nothing.

I tried to explain to him that amendments are part of the constitution in some other thread. You know, since the constitution says they are. I'm not sure if he can even read.

                  • So Ben, what's the comprehensive list of Constitutional amendments you deem unconstitutional? (You needn't include the 18th on the list)

                      Proper Catholics are socialists.

                        • Even if said laws passed they'd be struck down as unconstitutional, because amendments (such as those in the bill of rights) are part of the constitution. So if somebody says that an amendment is unconstitutional, and they're not referring to the 18th, then they're retarded.

                          • XI - State Sovereign Immunity. That's fine.
XII- President + VP tickets. That's fine.
XIII- Involuntary Servitude. Great amendment as passed. I don't like that the military draft isn't 'involuntary servitude', and that students are required to attend school. I don't see how you can square either of these with the 13th as worded in a time when neither were required.
XIV- Equal protection 2,3,4 sections are all fine. Section 1 is problematic. I don't see how you can square a progressive income tax with the equal protection clause. I would like to see the XIV extended to protect unborn children.
                            XV- Voting, fine with it.

XVI - Income taxation Total crap.

XVII- Direct election of senators. Fine with it.
                            XVIII- Prohibition Total crap.

XIX - Women vote. Fine with it.

XX- Presidential succession. Fine with it.
XXI - Abolished prohibition. Fine with it.

XXII - Term limits. Fine with it. Should be expanded to include senators and representatives.

XXIII - DC Voting. Total crap. Should be tossed.

XXIV - If poll taxes violate equal protection, then so do income taxes. XXIV should have abolished the XXVI, just like the XXI did the XIX.

XXV - Presidential succession. Fine by me.

XXVI - Lowering election age. Fine by me.

XXVII - Congressional Pay. Fine by me.

Explain to me why Poll Taxes violate equal protection and progressive income taxes do not, and I'll be happy to concede the point.

As it is I feel the XVI is just as much crap as the XVIII, and deserves as much respect as the XVIII.

                              • Wait - are you opposed to progressive income taxes in particular, or income taxes in general? It appears that, to nobody's surprise, you're shifting the goal posts. I'm not going to address progressive taxation unless you first admit that a flat tax would be fine - otherwise there's no point in my addressing progressive taxation in the first place.

And explain what you mean by the 16th amendment being "crap." Do you mean that it is unconstitutional? Do you mean that it is constitutional but that you are not bound by it?
