      No. The violation of the child should be illegal. May I point you to the slippery slope. Current child porn laws originally stated that child porn was illegal to sell or possess. But then because they couldn't tell if it was a child or not they said that it was illegal if it looked like a child. Since some cartoons/CGI are so realistic that you can't tell they made those illegal too.

      Saying that the government should simply not broaden these definitions is MISSING THE POINT. This is the slippery slope. It is not something you can prevent. It is completely inevitable.

        It is. Production of child pornography is an even more serious offense than selling child pornography which is an even more serious offense than possession of child pornography.

        May I point you to the slippery slope. Current child porn laws originally stated that child porn was illegal to sell or possess. But then because they couldn't tell if it was a child or not they said that it was illegal if it looked like a child. Since some cartoons/CGI are so realistic that you can't tell they made those illegal too.

        The laws governing child porn are not sliding down a slippery slope in any region but Australia, the nanny state.

        • They are in fact sliding and have in fact slid in the USA. An upcoming supreme court case will hopefully restore our first amendment soon.

          The maximum sentence for a girl sending a cell phone picture message to her boyfriend of herself naked is something like 10 years and being placed on the sex offender list and 17 year olds have in fact been prosecuted for this. It is an entirely victimless crime and is a derivative of the child porn laws.

                I don't know what you don't understand. I'm repeatedly and explicitly referring to two adults simply roleplaying in the privacy of their own bedroom. Your argument and your logic says this should be illegal.

                    Last I heard states were introducing laws pertaining to sexting to ensure this explicitly DOES NOT happen. There was an article on this the other week somewhere that I'd read.

                    Also, it's not a victimless crime...the girl herself is a victim, whether she understands it at the time or not is not really relevant.

                          Please read up on the US laws. As I recall, in some sort of preliminary hearing before the supreme court, a federal prosecutor admitted that Romeo and Juliet might be illegal under federal law.

                              That is unfortunate however there are lots of unfortunate things the first amendment allows. The logic of the first amendment is that the cons of the government being unable to regulate speech are vastly outweighed by the pros of no longer being capable of significant abuse.

                                If the catch-all laws on child pornography are too broad, they can legislate exceptions as necessary. For example, sexting:

                                "Sexting," a practice of sending or receiving lewd or suggestive photos among youth, should be a crime, the House said Thursday.

                                The bill would apply to those younger than 17 who "knowingly possess or transmit" the images of others under 17 engaged in "sexually explicit conduct."

                                Baldone said the offense would be a misdemeanor crime, not a felony, with fines ranging from $100 to $250 and imprisonment of not less than 10 nor more than 30 days.

                                Jail time can be suspended if a judge orders the youthful offender to perform at least 10 eight-hour days of community service.

                                "This is a slap on the wrist, not a felony. We wanted to create something lesser" than a felony for teens, Baldone said. "This is a lesser offense to the possession of child pornography."
