There should have been a plaintiff case brought forward that would have challenged the constitutionality of denying a minority group an equal right to marry.

I wasn't ignorant of the case that was actually brought forward on question of amendment versus revision. My anger is that they completely dodged the question of whether or not Proposition 8 violates equal rights protection.

Then I guess the problem isn't with the court but the fact that the activists brought the wrong case.

States rights, unlike gay marriage is found in the constitution. You might want to read up on Clay's arguments well before the Civil War.

It may only be 14 words but it radically changed the meaning of the equal protection clause. That's why I say it was actually a major change.

What exactly does the phrase "Constitutional Amendment" mean to you? OMG!!! A Constitutional Amendment slightly changed the meaning of a clause in the Constitution!

As I've been twittering, I think the MSM has really fallen down on the job. To take a question of whether a certain initiative is an amendment or revision to the Constitution of the State of California and say it "caved in the pressure of mob rule" is being completely ignorant of the situation. Completely.

Of course it has, if the job is accurately reporting the news. "Court interprets constitutional change provision according to text and precedent" is both more difficult to convey and less sexy and attention-grabbing than "Court says no to gay marriage."
