                You're in Canuckland?
                One option is to counterclaim for the other person's negligence. Still, if I've learnt ANYTHING about law from law school, is that the first thing you do when you have a civil claim is avoid going to court except as a last resort. It's just too costly. Consult your solicitor, but it may be better to negotiate, go into mediation, or go into arbitration before heading off to court. This is so even if ultimately it involves paying money to the other party.

                  Since there was a third vehicle involved (the truck) there are probably witnesses who have already made statements. Forget all about the dead bikey and the complainants- that's the person who matters.

                    Since there was a third vehicle involved (the truck) there are probably witnesses who have already made statements. Forget all about the dead bikey and the complainants- that's the person who matters.
                    That's a good point. AFAIK, there hasn't been any grounds for further investigation after the initial inquiry, which makes me suspect that they simply said it was an accident, rather then the fault of the motorcycle.

                        I agree that all lawyers are the scum of the earth. They are greedy, cynical, selfish, and earn far too much for their current perceived work.

                        However, I specifically carve out a safe harbor provision for law STUDENTS. Particularly those who are in their third year and who are applying for admission to the bar. Those are altruistic, idealistic, generous to a fault, and woefully underpaid for their contributions to society. And you can be sure once they're admitted and start practicing, they're going to make the world a much better place.

                          One of my best friends and the fellow who brought me to Christ is a patent lawyer.

                          Just this lawyer in particular seems rather filthy.

                                No they're not; don't listen to her. All that BS is mercilessly stripped away by the end of the first year and she damned well knows it.
