@ Ramo: I've already said that there were numerous issues (competence, dubious financial ties, etc) with his guy that contributed to this guy's downfall and I've even gone to the trouble of pointing a few of them out. I don't think its possible for any fair minded person to pick one issue out of the horrid mess and say that was the one to do him in.

No. There's a full vote in the Senate. Schumer is widely considered to be one of the most powerful Senators, having engineered the current D majority as the head of the DSCC for two cycles, currently the third ranking D (as Vice-Chair of the Caucus), and is a likely successor to Reid (Durbin would probably have to wait at least until Obama's out of office). This is a really odd arguement. Unless one accepts the limitation held by Mr. Freeman placed upon discussion as to why his nomination failed, your opinion is irrelevent unless you happen to be in a position of power. I don't really accept the premise of the arguement but find it hard to argue against someone that is simply going to shove his fingers in his ears and shout I can't hear you so I'll leave it at that.
