        OK we're almost at the "back and forth getting nowhere point", but a few quick rebuttals and then I'll let it rest.

        The Constitution does say "immediately". It doesn't say wait for a new congress or wait for the next congress nor does it stand quiet as to when the House should decide. It says "immediately".

        The House could theoretically end in a tie but since the Senate has a tie-breaker it can't. That is why it specifically says that whoever the Senate chooses as VP will be acting president if no decision is made by January 20th. If the Senate could end in a tie they would have had a procedure for what to do. The only way this is possible is if the old Senate takes the vote "immediately" because the new Senate would not have a President of the Senate until the new VP is determined. In which case there could theoretically be a tie in the Senate.

        Earlier it was stated that the VP only has tie-breaker votes on legislative issues. This from the US Senate's own website:

        While vice presidents have used their votes chiefly on legislative issues, they have also broken ties on the election of Senate officers, as well as on the appointment of committees in 1881 when the parties were evenly represented in the Senate.



        Thus there is a precedent for the tie-breaking vote to be used for non-legislative purposes and specifically to break ties on elections.

        In actuality I think there would be way too much pressure on the Senate to give Obama the VP he wanted and at least 1 would go with the Dems.
