  • Hospital decides it was wrong to multilate child on parents behalf

If you don't recall from not solong ago ago.... the parents of a child who is going to be in a vegtative state her entire life, had her ovaries removed and given hormore treatment to ensure she never grows larger so their "pillow angel"(their words) will be easier to care for.

Now........ the hospital decides "Oops, yeah, our bad."

Hospital: We Shouldn't Have Kept Girl Small

SEATTLE -- A Seattle hospital acknowledged breaking state law when doctors performed a hysterectomy on a severely developmentally disabled girl whose parents have pursued medical treatments to stunt her growth, making her easier to care for.

Sterilization surgeries must not be performed on children without a court order, Children's Hospital and Regional Medical Center said Tuesday after an investigation by Washington Protection and Advocacy System. The hospital also agreed to appoint "someone with a disability rights perspective" to its ethics committee.

Doctors performed the experimental surgeries in 2004, removing the girl's uterus and breast buds. The girl, identified only as "Ashley," was 6 years old at the time. The hospital's ethics committee supported the treatment, which included hormone therapy, but noted before the surgeries that court review would be required.

A lawyer for the girl's parents disagreed, saying the state law did not apply in Ashley's case, and the hospital performed the procedures without court permission. Ashley was diagnosed with severe brain damage shortly after birth, and her condition has left her in an infant state, unable to sit up, roll over, hold a toy or walk or talk.

"We deeply regret that a court order was not obtained and that an independent third party was not sought to represent Ashley. We take full responsibility for the miscommunication between the ethics committee and the treating physicians," said Dr. David Fisher, the hospital's medical director. "We have introduced new safeguards so that procedures requiring a court order will have one obtained before they begin."

Ashley's doctors touched of a highly charged ethical debate when they wrote about her treatment in October's Archives of Pediatrics & Adolescent Medicine. Some critics decried the parents' actions as perverse and akin to eugenics. Her parents maintained that keeping her small would make her more comfortable and allow them to move her more easily and take better care of her.

On their blog Tuesday, Ashley's parents praised the vigilance of the advocacy group that investigated the case. But they also said they hoped requiring court orders in such cases would not create obstacles for parents seeking the best care for their disabled children.

"As responsible and loving parents, deeply concerned for the well-being of our child, we provided a better quality of life to our Ashley, who is doing very well under our love and care," they wrote. "We hope that other families of the many children like Ashley will likewise be able to care for and benefit their children without undue obstacles."

"People concerned with the rights of individuals with disabilities still have a lot of questions about why this type of invasive and irreversible procedure would be performed on a 6-year-old," said Curt Decker, National Disability Rights Network executive director. "We hope that the agreement between WPAS and Children's Hospital will be the first step in resolving this issue and that the long-term result will be an end to the use of the 'Ashley Treatment.' I know the entire disability community will be carefully watching the implementation of this agreement."

Sounds like a state driven lawsuit in the making.

I hope so. I can empathize with the parents. Really, obviously it is awful to have a child who is essentially a vegetable, yet you are required legally to care for and emotionally are attached to.

But does this justify something as drastic as stunting their growth? Whats next, doctors recommending this as "the optimal" procedure for those with retarded children? How long till it stops being those who are essentially vegetables, but simply lower functioning? And how long after that? Etc.

The slippery slope here seems DAMN steep and not so far off from german mass euthonization of the retarded.

Yeah I heard about this earlier. It used to be the standard treatment for the mentally handicapped to be sterilised and put in homes. It was supposed to keep them from having children, the exact same motivation that the parents had here.

The growth stunting was an additional step. Glad to see that the hospital won't be doing any more of these, but they can never restore the child they harmed again.

Additional step.... to prevent her from.... breeding? She is a vegitable. She can't breed unless someone rapes her. This had nothing to do with preventing her from having children, the primary motivation of the parents(as explained in their earlier interviews) was to make her easier to care for.

There's not a slippery slope at all here, just level ground. This girl is not "retarded" or "developmentally disabled" or whatever you want to call it. I've seen Downs kids, I have a couple of friends who have worked with all sorts of developmentally disabled kids of all sorts, in group home and higher level care settings (not even talking about low to moderate functioning kids).

It might be easier for this girl to be vegetative - she does have some sensory awareness, just not any cognitive function to be able to process it. She'll never function even minimally on her own, or with "assistance" - she will constantly need everyone to do virtually everything for her, like a perma-infant, for as long as she lives.

What possible benefit is there for her to go through puberty or grow physically larger? That would significantly complicates her care requirements above and beyond what they already are, and she's in a particularly rare, almost unique medical situation with absolutely no hope of improvement.

It's a lot different from lower functioning, who can learn (albeit very slowly and with limitations) to perform some basic life functions and to participate with assistance in performing other basic functions.

Since this girl will never be able to speak, understand language beyond some primitive understanding that mommy and daddy's soft cooing sounds are nice, and never get out of diapers, reproduction outside of rape is a non-issue. Any sick bastard who raped a kid/adult in this condition should be made to dig their own grave with their bare hands, and then dispatched with a shotgun load of rock salt up their ass.

The growth stunting was an additional step.
The parents' motivation was prevention of menstruation (a sanitary and care issue, plus emotional disturbance to the child, as she has panic reactions and major fits at the sight of blood, and nobody can, or ever will be able, to explain anything to her), and limitation of physical growth so that she will be able to be cared for. (She'll require lifetime care on a 24 hour basis, and who's going to do it if the parents won't or can't?)

they can never restore the child they harmed again.
How exactly was she harmed? Loss of "reproductive rights?" God grant that she'd ever have the cognitive function. Staying physically smaller? Not like she was going to make the high school field hockey team or be prom queen. Potty training would be a lifetime accomplishment.

Why is this child still alive?
