If there was no question about the status of its ownership, then why did Lincoln's secretary of state agree to evacuate it?
That's what happens when both sides agree to peaceful separation. You can't have the armies of a foreign power spread throughout your territory. The Confederacy was prepared to compensate the Union for all federal installations.
