    Court blocks state school-exit exam

    A court order on Friday would allow some 47,000 students to graduate in 2006 even though they have not passed California's high-school exit exam.

    Ten students and their parents had sued, alleging that the test discriminated against low-income students and those for whom English is a second language which they are still learning.

    The class of 2006 would have been the first that would have been denied a diploma for failing the exit exam. Around 47,000 students, more than 10 percent of the total, still have not done so.

    Alameda Superior Court Judge Robert Freedman noted the "potentially devastating effects" of being denied a diploma, and said that as a result of "system wide disparities as to 'opportunities to learn' the material tested, the Court concludes that an injunction that may result in a windfall benefit to some is preferable to the alternative of no relief for those who are truly victims of a system which, although it shows signs of recovery, is still unwell."

    State education officials said they would appeal and seek an immediate stay of the ruling. Graduations in some school districts are scheduled next week, but it was unclear how they would be affected by the uncertain situation.

    Freedman specified that the injunction would not halt testing or remove the exit exam from application to future graduating classes.

    "Under today's ruling students lose," said Jim Lanich, president of California Business for Education Excellence. "While it may seem harsh to prevent students from graduating if they've met all the requirements except for passing the (exit exam), giving them a false sense that they are ready to enter the workforce or college prepared for those challenges is a much worse punishment. It doesn't help students to award them a high school diploma if they graduate without fully comprehending basic reading and math skills.

    "The fact that four of the ten students who originally brought this suit have now passed the exam shows the exit exam is having the desired effect," Lanich said in a prepared statement. "Students are rising to meet the challenge. Those who are finding it more difficult, such as the students who originally brought the suit, are getting the help they need to pass."
    How exactly is giving a diploma to people who can not pass a test requiring only basic skills going to be of any help to them?

    If this stands (and I don't see it doing so), I think businesses are going to try to find out if diploma holders passed that exit exam.

      Why don't they just do what they did at my university in China? Have the students take a "make up" test.

        Hang on, this is ridiculous. If a prerequisite is to be able to speak good English, when going out into an English-speaking working environment, I'd say it's pretty damn important. Fools...

            Poor, poor babies (and their parents) are feeling left out and left behind in our English-speaking working environment just because our education system assumes they can speak usable English upon graduation...

              Some people are just bad test takers.

              But this is going a little too far. In a few years Arkansas is going to require passage of a state exam for graduation (I think they're doing it next year for eligibility to pass from one grade to the next, if not 12th to diploma) and California needs to figure this out, a bad precedent will screw us all over.

                I don't get this attitude of sueing.

                Like, if English is your second language and the test is a bit difficult because of that.. well.. how about it takes you a year or two more to graduate then, while you're learning the hoops and the language?

                WTF?!?!?

                IT's like 'I didn't get it, but it's my RIGHT pass anyway' and then everyone sues everyone.

                Only in America . You should take up excelling again as the primary goal instead of average joe. Because average joe is fat, lazy and freaking stupid.

                  That's interesting. If this is indeed possible, why does it matter what the state sanctions then? If employers can just ask each person if they've passed the test, then you can sort of bypass the state if it becomes a norm for employers, right?

                    They do. Students get three chances to pass the test yet 11%, mostly latinos and blacks, were still failing. I've seen example questions from this test and it is so basic that if you can't pass it you really are a drooling idiot who does not deserve to graduate.

                    That so many of the failing students are minorities is being used to claim the test is racist. I honestly can't see how that claim has any merit.

                      I agree. The test was designed to stop social promotion and instead to make sure that a diploma meant something. The test is supposed to insure that every one who gets a high school diploma has basic skills needed to be successful in the job place. The test is so watered down now it is an utter joke which measures only the most basic reading skills, writing skills, and math skills.

                            The test isn't racist, but the circumstances which leads to mostly minorities failing the test is racism. However, just because you have been vicitimized by a system of oppression it doesn't mean you don't need certain skills in order to be able to function at more than a survival level in this society. If someone breaks my leg, that doesn't mean I get to win a foot race automatically.
