In any event, it seems clear that the SWC did not deliberately plan to build a museum on top of a cemetary (which seemed pretty absurd at first blush, as well).

Quite a different story than the one presented by the Independent and lapped up by MOBIUS.

i note that the mufti did NOT sue for the property when the city was using it as a parking lot.

My guess is that when someone found some bones, the mufti reasoned that anyplace that had been a muslim cemetary must have been owned by the Waqf, whether a deed existed or not, and however it ended up in govt hands it was a confiscation.

This would get to the details of Ottoman land law, Waqf record keeping practices, etc. An excellent topic for the Israeli courts to discuss. Why the Indy should make a big deal about it, well .......

Personally, being an aethist, I don't think handling human remains is a Bad Thing (how about those evil archeologists, eh?), but if I was a believer and I thought that the way to respect the dead was to treat their remains with respect, I could certainly see drawing a distinction between paving over a cemetary and digging one up & moving the bodies. Not that paving over it is particularly respectful, either, but there is a difference.

yeah, but if it was unlawfully confiscated from the Waqf, hed not only have the right to sue for it, i suspect hed feel obliged to sue for it.

You can't be sure of that. All you can be sure of is the remains found were not disturbed. There may have been many other remains that were but there's no evidence of it now. For all we know they may have discovered remains while building the parking lot and decided not to do anything about it.

If we couldn't build on cemetaries, we wouldn't be able to build anywhere. as to it being the tombs of the friends of Mohammad... .. the chances that these are the actual tombs of mohammad's friends are equal to the chances that Mohammad flew to the sky on a horse, i.e. somewhat slim. There are plenty of "tombs", some of them of old testament characters.. don't mean they actually belong to them.

Noone cares about this. It's not even a muslim shrine, or anything - as those are operated by the waqf.


As to Mobius' avatar - I like it. It's freedom of speech at it's finest + it makes Mobius look like a complete ass. 2 out of 2 if you ask me.
