  • Rule 75.4(iii) Misconduct penalty for incitement:
    Any player or goalkeeper who, after warning by the Referee, persists
    in any course of conduct (including threatening or abusive language
    or gestures or similar actions) designed to incite an opponent into
    incurring a penalty.

    So sorry, not game misconduct. Simple misconduct penalty.

    The goaltender has to stand where he is. He can't skate away or turn his back on the aggressor. A hand or stick at face level close to you are aggressive, intimidating gestures. If somebody did that to me when I was playing a game with them then I would take a swing at them, and I'm sure Avery would have loved it if Brodeur or his teammates had done just that.

    That type of behaviour is unacceptable, and the refs should have controlled it.

            • I can guarantee you that there was a conference call between officials and the League this morning about that "tactic".

              I hope Avery tries it again. His ass will be in the box.

                Using that penalty would require that the offender be warned first. THat was not really possible on the clip I saw and I don't know if the tactic continued.

                BUt if the referee finds that a swinging of a stick is intimidating, he can call a slashing penalty immediately. I think their problem was that the intent was to distract and disrupt vision but I never really saw a threat that he planned to swing it down on Brodeur.


                I don't like this type of play and think it should be illegal sicne the goalie has to be where he is. But currently I am not sure it IS illegal as the rules have been previously interpreted. It would however not be much of a stretch to say that all sticks waved at eye level are intimidating and therefore are slashing

                        Actually, from a different camera angle, you could see the ref clearly skate in and tell him to stop, just before Drury does the same.

                        • Rule 61- Slashing is the act of swinging the stick at an opponent whether contact is made or not.

                          They go on to NOT penalize certain non-agggresive stick contact


                          So the slashing rule seems to solely rest on whether you swing a stick AT an opponent

                              • Bettman speaks on "The Avery Rule"

                                Bettman said he discussed the matter with Colin Campbell, the NHL's senior vice president of hockey operations, on Sunday afternoon already. Their joint verdict: "It's something that we're going to address, probably in the realm of either goaltender interference, or unsportsmanlike conduct. We'll put the clubs on notice before we make that interpretation. But the ingenuity and creativity of things we've never seen before never ceases to amaze us. But we'll deal with it."

                                Bettman's tone said as much as his actual words — he was clearly unhappy with Avery's antics, even after acknowledging his ingenuity and creativity, because of the black mark they cast on what has been another exciting first round.
