Rule 75.4(iii) Misconduct penalty for incitement:
Any player or goalkeeper who, after warning by the Referee, persists
in any course of conduct (including threatening or abusive language
or gestures or similar actions) designed to incite an opponent into
incurring a penalty.
So sorry, not game misconduct. Simple misconduct penalty.
The goaltender has to stand where he is. He can't skate away or turn his back on the aggressor. A hand or stick at face level close to you are aggressive, intimidating gestures. If somebody did that to me when I was playing a game with them then I would take a swing at them, and I'm sure Avery would have loved it if Brodeur or his teammates had done just that.
That type of behaviour is unacceptable, and the refs should have controlled it.
