An occupational hazard for a thief or justification for a murder charge?

    Everything that happens to everyone is dictated by choice and personal responsibility, even accidents. It's literally impossible for an innocent person to be killed, ever.

          None of the so-called perpetrators have been convicted of a crime. It seems the murderers are the only real criminals.

              They saved the state the time an expense of a trial and prevented the thieves from victimizing others. Their actions were quite heroic I say.

                Absurd hypotheticals like the woman who crashed her car and stumbled upto someones house and banged on the door, only for the homeowner to shoot her dead?

                        Jackson County Prosecutor Jean Peters Baker has charged an Independence man with involuntary manslaughter in the death of Kyle VanWinkle. He was repeatedly punched after he was found sleeping in the wrong vehicle at Arrowhead Stadium on Dec. 1.

                        Josh T. Bradley, 25, was in court Friday morning and a judge set his bond at $75,000 cash only.

                        Baker will hold a news conference at noon to discuss the charge.

                        VanWinkle, 30, died on Dec. 1 after becoming involved in a fight in an Arrowhead Stadium parking lot during the Kansas City Chiefs game against the Denver Broncos.

                        Court documents released last year say that the victim was repeatedly punched in the face after he was found sleeping in the wrong vehicle by the owner.

                        Police arrested and questioned Bradley, who did not own the Jeep that VanWinkle was found in.

                        A witness found a bloody VanWinkle lying on the ground. He wasn't breathing, according to court records. Good Samaritans performed CPR until paramedics arrived and rushed VanWinkle to an area hospital, where he would die.

                        VanWinkle suffered fatal injuries to his head and neck, according to an autopsy.

                        "I believe firmly that the charge that we've presented today is the appropriate charge and this is a proper charge based on the evidence that we have," Baker said.

                        VanWinkle's widow and father were among those at the news conference. He had a son born just a few months before his tragic death.

                        "Kyle was a hardworking and honest young man who sincerely loved people and cared about people especially his family," said Dean VanWinkle, who is also spokesman for the Grandview Police Department.

                        VanWinkle apparently mistakenly got into the wrong vehicle, which was unlocked. The Jeep looked similar to the one that VanWinkle arrived to the game in and was about 10 vehicles away on the same row.

                        The Jeep's owner who was accompanied by his young son said VanWinkle appeared to be intoxicated.

                        He said he asked his young son to run and ask for help from nearby tailgaters. He said VanWinkle and Bradley and others became embroiled in an argument. The Jeep's owner said Bradley just began punching VanWinkle, according to court documents.

                        "The witness stated the victim went down to the ground and the suspect hit him while he was on the ground," according to court documents. "Other witnesses reported seeing the suspect punch the victim, knocking him to the ground and continuing to punch him after he went down."

                        A defense attorney for Bradley in December had defended his actions. He said his client was remorseful and it was a misunderstanding. Bradley is apparently getting a new defense attorney.

                        According to court documents, Bradley asked for an attorney when questioned by detectives and did not give a statement.
