I don't he's trolling because that performance was embarrassing. He'd have more respect, if he actually believed that nonsense.

DinoDoc, basically you'd say that if someone ran into your house for any reason and you shot them it isn't murder. Stop being simple for ****'s sake.

I've checked the statutes in Maryland and at the Federal level. Neither of them define premeditation, but luckily there are dictionaries.

Cambridge Dictionary Online: "thought of or planned before being done"

Oxford Dictionaries: "The action of planning something (especially a crime) beforehand"

Merriam-Webster: "characterized by fully conscious willful intent and a measure of forethought and planning"

The Free Dictionary: "done with willful deliberation; planned in advance."

I believe you that "stopping to think" has counted as premeditation in the past, but I disagree with that definition. Planning is an essential element of premeditation. Jurors have a responsibility to keep over-zealous prosecutors in check.

If it were up to me, I'd call the killing of the girl murder in the second degree.

I don't care all that much about the particular charge. That's for pedantic lawyers to worry about. Like IMRAN

I'd say the time taken, including reloading, qualifies it as premeditation.

And, like you, I care about what's right more than what the law says, but we have to rely on the law, alas. Several quiet minutes spent reloading blows a hole in a heat of passion argument almost as big as the holes he coldly and deliberately blew in her. Plenty of time to reconsider while she was at his mercy; mercy he didn't extend.

I think Sid did an edit after I saw the post fresh, but I stand corrected on that. He did sorta say.
