      I think it would probably be fair, but I don't know if it would be perceived that way.

              I think I remember something about some of the procedures at the Hague that the U.S. disagreed with but I can't recall exactly what they were. Still, I believe that his best chance of getting a fair trial is a U.S. Military trial. They have every reason to make sure that it is a model of fairness while they still have troops on the ground in Afghanistan...not to mention about a billion reporters looking for the slightest irregularity.

              Also, we have an agreement with Afghanistan that U.S. soldiers will be tried in U.S. courts. It would be the first step in unfairness to single this soldier out.

                Fair enough. I am uncertain that any type of international tribunal would be the answer. There are a lot of different agendas in the international arena. It might be a fair trial...it might not.

                  The precedent it would set is, to me, the most dangerous part of that. This particular case may go as it is supposed to but what about the next one....

                      That's about the same amount of faith the Afghans will have in a US military tribunal.

                        I suspect this soldier will get a perfectly fair trial in the military court. The afghans may not see it that way, but that is not the point of the trial. Nor should it be. That does tend to be the point of these international tribunals, however. They are as much or more about optics than justice.

                              I'm talking about how the trial will be perceived by Afghans and you are going on about whether it will actually be fair or not and how ****ty the international tribunals are.

                              I don't know if the defendant will get a fair trial or not by a military tribunal (I'll leave others with more interest in that aspect of it to argue) but I do know how the process is seen by Afghans is most important to the military/political situation on the ground (the point of the thread, no?).
