Yes, why should we start killing people who haven't been convicted of any crimes? I can see why we would need that in some situations, like a war, but if someone can be taken prisoner I don't see why we should just shoot them.

Yes, and they're bull****. What is a "crime against humanity?" It's basically something so awful we don't have something on the books for it, which is textbook ex post facto.

Vigilante justice has been around for a long time too.

So the thing is here, that by killing Gaddafi, you've now shown what will happen to other leaders like Saleh or Assad if they back down. Instead, they should have given him a happy exile. Now what we have are the leaders of nations fighting for their lives against their people. It doesn't matter how much they deserve to die for their crimes, it isn't worth consigning the innocents who will be slaughtered by scared dictators to their deaths just so we can have our petty revenge.

They did something that society had already decided beforehand was worthy of the death penalty?

No, he's not. This is like reverse moral hazard.

Sorry, I must have missed the part where society decided that it was okay to slaughter thousands for blatant personal gain.

And you act like a child when people disagree with you.

That's not what society decided. Society implicitly decides, by practicing kangaroo courts for "crimes against humanity", that we can invent crimes punishable by death for leaders who have lost favor in a dramatic way. So far we have never seen it applied to people who are not obviously atrocious men, but that is not a guarantor of future responsible use of institutions like the ICC. As an example, all those people who wanted to stick Bush up in the ICC for "war crimes".
