I simply have an issue with the idea that the province can simply create a tax IDENTICAL to the GST on their own authority. I think that is most likely NOT a correct assumption

Why? Seems pretty clear to me, that the province could create a tax similar to, if not exactly the same that would hit the same people in the same way.

Many things are very clear when one does not trouble yourself with nuance, exceptions, reading caselaw or trying to undersrand it. As I said before, I am uncertain on the point and unlike others , AHEM, i do not tend to spout off on legal matters without checking . The Quebec reference may be the case I need to look at, although if there was federal enabling or complementary legislation it may not be determinative.

Ben, you may turn out to be correct and the province could implement a tax IDENTICAL to the GST on its own authority-- obviously they can apply a retail sales tax . . but retail sales have a local nature which is not at all the same with respect to many services to which a VAT applies. I also take note that , to my recollection no province has enacted its own GST style tax, except working with the feds.

So if you want you can research it yourself and cite chapter and verse of applicable caselaw ( BUT instead why not just rely on your own opinion) After all thats just bound to be accurate with respect to the intricacies of tax law-- LOL

I believe it to be the case. I agree that the taxes wouldn't be identical, but for all practical purposes they would be. If you can find something contrary, by all means, I'll gladly concede this point. But, AFAIK from what I've looked at indicates that the PST exemptations could be altered by the province to square up with the GST, entirely under provincial authority.
