If the religious oath violates civil or criminal laws then they're breaking the law no matter if they're attempting to use religion to justify it. This is like those evangelical groups which outlawed marriage between people of different races because "god created the races as separate and that is how it should stay".

Segregation would seem to be more what he was aiming at. Slavery isn't lack of equal rights so much as lack of rights at all.

So gay people are challenged at the poll booths, have to sit in the gay section of the cafeteria, have 'gay' only bathrooms, and gay water coolers?

I don't see how they are in any meaningful sense segregated.
