That and later amendments override prior ones, or parts of the original Constitution. So saying how can income taxes pass equal protection test is moronic.

Even if said laws passed they'd be struck down as unconstitutional, because amendments (such as those in the bill of rights) are part of the constitution. So if somebody says that an amendment is unconstitutional, and they're not referring to the 18th, then they're retarded.

Reminds of a libertarian politician, who not too long ago, claimed that part of the 14th Amendment is unconstitutional.

XIII- Involuntary Servitude. Great amendment as passed. I don't like that the military draft isn't 'involuntary servitude', and that students are required to attend school. I don't see how you can square either of these with the 13th as worded in a time when neither were required.

Yeah - cause we all know that compelling children to go to school is just as horrendous and brutal as slavery was.

Wait, it's involuntary servitude when kids have to go to school? What about when parents make their kids go to bed? Why didn't the 13th amendment liberate kids from the tyranny of their parents? How dare adults boss kids around!
