Why would they be unavailable? If the government doesn't buy the patent the drug company can still make the drug and sell it just as they would if the government didn't buy any patents. Firefighting and medical care are not public goods. Firefighting approaches it in the limit of dense buildings (e.g. firefghting in a single apartment complex is pretty much a public good, but as demonstrated in this instance, firefighting in Butt**** Tenn is not).
