        Why would they be unavailable? If the government doesn't buy the patent the drug company can still make the drug and sell it just as they would if the government didn't buy any patents.           Um, what? Are you suggesting the government just negotiate a price? Because then you don't even have a market, just two isolated parties, and the government wouldn't have any special bargaining position (modulo eminent domain, etc.). Most suggestions for government patent buyouts involve some sort of auction.

                        • Non-rival: it doesn't cost any more to protect everybody than it does to protect everybody minus one person (in other words, my consumption of national security does not reduce the availability of national security to you)

                          Non-excludable: it's not possible to withdraw national security from me alone if I choose to forego it

                          It therefore matches the definition of "public good".

                          • Firefighting and medical care are not public goods. Firefighting approaches it in the limit of dense buildings (e.g. firefghting in a single apartment complex is pretty much a public good, but as demonstrated in this instance, firefighting in Butt**** Tenn is not). Police protection is closer to a public good in more situations, but is not as perfect an example as national security...

                                The marginal cost to provide fire protection at any given instant is VERY DIFFERENT than the marginal cost to planning to provide fire protection.
