Warman could sue for defamation because people used his actual name. I haven't, and I won't. You don't have a case, poster formerly known as Asher. Just because some invalid complaints are taken doesn't mean that all of them are taken.

I don't know what gave rise to the initial "complaint here but (without reading their legislation) the BCHRC form for filing complaints is very specific in that a matter MUST relate to one of 9 areas

employment
services
tenancy
employment advertisement
publication *
purchase of property
lower rate of pay (gender only)
membership in a trade union
retaliation

Of these only "publication" seems to fit anything on the internet-- the form says it means making something public by a statement,notice, sign, symbol emblem pr other representation that is discriminatory or is likely to expose anyone to hatred or contempt

I am not up on the latest HRC decisions but I tend to doubt anything said on a chat board such as this would get much sympathy. The area appears more aimed at the swastika painter-types.

these tribunals are supposed to have somewhat narrow ranges of jurisdiction. What did Ben do that asher thinks is worthy of a complaint?

The problem was Ben was lying to defame my character. He repeatedly accused me of "stalking" him elsewhere. Claims easily disproven by the fact that I was there 3 years before he ever went there.

I was trying to wind him up by using his irrational hatred of the HRC against him (which he has repeatedly claimed had 100% conviction rates, were a tyranny to free speech, etc) by telling him I was filing a complaint.

In almost no time at all, this new poster came in and reminded people not to send hatemail to the address Ben gave out without specifically specifying Ben's full name, as he didn't want the mother opening up the mail by accident. I PMed the guy to verify if he knew Ben in person, he verified that he was Ben's brother.

Ben is now claiming that I am this poster (Zanzozz), and that I PMed myself so that I could have a PM but then never be stupid enough to show it on the site --because if I did, I would be banned.

Thanks for the summary-- I had seen the brother bit in this thread but missed the original issue.

I think any HRC would turf this in seconds. Defamation, lying, slander etc etc might be actionable in court but for a HRC you need prohibited grounds of discrimination. Usually in a Ben/Asher thing I could see religion and or sexual orientation being potential factors but am unsure here.

I have seen HRC's do weird things. They do not have 100% 'conviction rates" but their role as impartial observer turned advocate has been questioned in many jurisdictions and they do tend to get agendas all of their own. I think they are an imperfect system but at the same time I do like that there is a less formal and expensive route for an aggrieved party who have faced an obvious violation of their rights. The focus on services and jobs and tenancies etc etc was a good one. I think as the HRCs have strayed further into speech, they have started running into issues. Mark Steyn has highlighted some of these fairly effectively although this can get lost in the fact that Steyn can be an idiot

I've mentioned it here before. Some of my friends call me Asher dating back to jr high, when there were too many Daves and I'd shared in a class project that my parents liked 'Asher' and almost used it for my middle name, but changed their mind when I was born. It stuck.

Why would Ben's family be such a secret? In most families there are dozens if not hundreds of folks that would know how many siblings there are?

Weird-- If I wanted to know something from a family member I would just phone them and ask. Why send PMs with questions of increasing difficulty that even you admit can be answered by others.
